    • 1. 연구 목적 및 필요성
    • SW에 관한 기본법인 SW산업진흥법은 1987년 제정된 SW개발촉진법을 모태로 하여 2000년에 SW산업진흥법으로 전부개정된 이래로 공공SW사업 규제 위주로 일부개정1)이 10여 차례 이뤄진 바 있다.
    • 2014년의 SW중심사회 실현전략2)을 뒷받침하고, 2016년 초 세계경제포럼에서 논의된 제4차 산업혁명에 이은 지능정보사회3)과 같은 변화에 부응하고자 과학기술정보통신부는 2017년 8월부터 TF를 가동하여 SW산업진흥법 전부개정안을 마련하였다. 이렇게 마련된 전부개정안은 2017년 12월 20일 공청회를 거쳐4) 2018년 3월 22일자로 정부입법으로 입법예고되었으며5), 2018년 11월 27일 국무회의를 거쳐6) 11월 30일 국회에 제출되었다7).
    • 2018년 정부입법계획8)에 따르면 SW산업진흥법 전부개정안은 6월까지 국회 제출예정이었는데, 관계기관 협의과정이 규제심사 및 법제처 심사와 병행하여 진행되면서 생각보다 많이 지연되어 연말에 즈음해서 국회에 제출될 수 있었다.9)
    • 이 과정에서 SW산업진흥법 전부개정안은 처음의 논의나 입법예고안과 달리 많은 부분이 수정되어 국회에 제출되었다. 따라서 이 연구보고서에서는 현행SW산업진흥법(이하 ‘현행법’), 입법예고안, 국회제출안의 체계와 주요 조문의 변화를 비교·분석하고자 한다.
    • 2. 연구의 구성 및 범위
    • 제 1장에서는 2017년 12월 20일 SW산업진흥법 전부개정안 공청회 이후 국회제출안까지의 경과를 정리한다. 제2장에서는 정부입법절차를 정리하고, 입법예고안의 부패영향평가와 규제영향분석 결과를 분석하였다. 제3장에서는 주요 조문에 관하여 현행법과 입법예고안, 국회제출안을 비교·분석하여 현행법의 한계점과 개정논의, 입법예고안의 수립배경과 외부 의견 수렴을 통한 국회제출안의 형성과정을 정리하였다.
    • 제4장에서는 이전부터 계속 논의되어온 민관협력방식의 SW사업의 제도화 논의와 도입방법, 그리고 국회제출안의 ‘민간투자형 SW사업’규정에 대한 분석을 실시하였고, 제5장에서는 결과를 요약정리하였다.
    • 3. 연구 내용 및 결과
    • 본 연구에서는 현행법, 입법예고안, 국회제출안 세 가지의 체계, 조문과 제개정 이유서를 비교분석하여 국회제출안의 의의를 살펴보고자 한다.
    • 3.1. SW산업진흥법 전부개정안의 분석
    • 3.1.1. 법률체계
    • 일반적으로 법률은 편장절관10)의 체계를 갖추게 된다. 현행법은 5장 48개조였는데, 입법예고안은 5장 10개절 93개조였었고 국회제출안은 7장 9개절 73개조로 구성되어 있다. 입법예고안에 비해 국회제출안은 SW사업분쟁조정위원회를 삭제한 것 외에도 많은 조문을 통폐합하고 일부 조문을 신설하였는데 각 장의 절을 세분화한 구조는 유지하였다.
    • 3.1.2. 부패영향평가와 규제영향분석
    • 부패영향평가와 규제영향분석은 정부입법의 필수절차이다. 부패영향평가제도는 법령 등에 내재하는 부패유발요인을 체계적으로 분석·평가하여 사전정비 및 종합적인 개선대책을 강구하는 것인데, SW진흥법 상의 전문기관의 지정 요건, 절차, 취소 등에 관하여 하위법령으로 위임할 때 위 사례를 참고하여 부패유발 요인을 사전에 차단할 필요가 있어 보인다.
    • 규제영향분석은 규제로 인하여 국민의 일상생활과 사회·경제·행정 등에 미치는 여러 가지 영향을 객관적이고 과학적인 방법을 사용하여 미리 예측·분석함으로써 규제의 타당성을 판단하는 것인데, 입법예고안의 ① 실태조사에 따른 대상 기업의 협조의무, ② SW안전관리 대상 지정 및 기준 준수의무, ③ 공공SW사업 재하도급 금지, ④ SW산출물 유출에 따른 입찰참가자격 제한이 대상이 되었다. 이를 통해 SW안전은 SW사업자의 세부안전기준 준수의무가 삭제되었고, 공공SW사업 재하도급 금지가 완화되었다.
    • 3.2. 총칙부터 기반조성까지
    • 3.2.1. SW산업의 정의
    • SW산업의 정의는 2000년 전부개정된 SW산업진흥법에서 처음 등장하였고 2010년 개정된 전자정부법부터 현행법과 같아졌으며 입법예고안까지 이어졌다. 그런데 국회제출안에서는 정보시스템에 관한 부분이 삭제되는 변화가 생겼다. SW산업의 정의의 변화는 SW사업에 바로 반영되어, 실태조사를 비롯하여 흔히 공공SW사업이라고 말하는 국가기관등의 장이 추진하는 SW사업의 범위를 정하는데 활용된다.
    • 문언적으로는 컴퓨터 및 각종 장비의 구매나 유지관리를 제외한 순수한 SW에 관련된 것만을 다루는 것으로 해석할 수 있으나, SW사업은 정보시스템 구축사업의 핵심요소로서 분리가 어려우며, 이미 SW사업 수요예보제가 정보통신융합법 제28조 및 제29조의 정보통신장비 관련 규정과 통합되어 운영되고 있으므로 실질적인 변화는 없을 것으로 보인다.
    • 3.2.2. SW안전의 정의
    • SW안전은 SW가 점점 널리 쓰이면서 내부적인 오류 등으로 인해 사람의 생명과 신체에 직접적인 피해를 주는 사례가 늘어나자 공청회 및 입법예고안에서 새롭게 도입된 개념이다. 입법예고안의 정의는 SW품질 또는 정보보호와 혼동된다는 의견이 있었으며, 이를 감안하여 국회제출안에서는 외부의 침해행위가 없으며 위험분석 등의 내용을 추가하여 SW품질 및 정보보호와의 구분을 좀 더 명확히 하였다.
    • 3.2.3. 실태조사와 SW산업정보의 관리
    • SW가 전사회적으로 쓰이는 추세에 맞추어 ICT실태조사의 하부항목으로 패키지SW와 IT서비스만을 대상으로 하는 실태조사가 아니라 SW와 관련된 좀 더 넓은 범위의 조사가 가능하도록 입법예고안에 SW 실태조사 조문이 새롭게 도입되었는데, 현행법 제14조(SW산업정보의 관리)와 상당부분 중복되었다. 이에 국회제출안에서는 내용을 통폐합하여 제7조(SW산업정보의 관리 등)가 매우 간단해졌다.
    • 3.2.4. SW사업자신고제도와 SW기술자신고제도
    • 현재의 SW사업자신고제도는 사업 인허가와 관련된 신고를 의미하는 듯한 조문명과 달리 SW사업자의 기술인력이나 사업수행 실적 등의 관리를 주요 내용으로 하고 있어서 국회제출안에서는 제57조(소프트웨어사업자 실적 등 관리)로 조문명이 변경되었으며, SW사업자가 제출한 자료의 진실성과 정확성을 확보하기 위하여 “대통령령으로 정하는 국가기관등의 장”에게 별도로 자료를 요청할 수 있도록 하고 있다.
    • SW산업계가 전반적으로 영세하여 SW생태계의 중요한 구성원인 SW기술자의 경력 등의 유지관리가 어려웠던 상황을 타개하고자 2008년 6월 22일 실시된 SW기술자신고제도11)도 같은 취지에서 조문명을 제24조(소프트웨어기술자의 경력 등 확인)로 변경하였다.
    • 3.2.5. SW공학기술 연구개발
    • 입법예고안에서는 SW 연구개발과 관련하여 공개SW 개발방식을 공식적으로 도입되었는데, 국회제출안에서는 추가적으로 국내기업의 SW생산성과 품질경쟁력을 강화하기 위하여 공학기술의 연구개발 SW 관련 조문을 추가하였다. 조문별 설명자료에 따르면 국내 SW공학기술 활용수준은 선진국에 비해 낮은 편으로 대기업과 중소기업 간의 격차가 심화되고 있어 SW 분야의 진흥의 기반이 되는 SW공학기술 경쟁력12)을 강화하는 각종 지원사업의 법적 근거가 마련된 것이다.
    • 3.3. SW사업의 선진화
    • 3.3.1. SW사업 영향평가
    • 국가기관이나 공공기관이 SW를 개발하여 무상으로 보급함에 따라 발생하는 민간시장 침해를 방지하고자 도입된 SW영향평가제도는 초기에는 국가정보화기본법 상의 국가정보화시행계획의 검토기준13)이었으나, 이후 현행법의 SW사업관리감독 일반기준 고시에 포함되었고14) 2017년 7월 21일 송희경 의원이 ‘SW사업 영향평가’를 포함하여 대표발의한 일부개정안이 2018년 1월 30일 통과되어 8월 22일 시행되면서 법제화가 되었다.15)
    • 현행법과 비교했을 때 국회제출안은 첫째 대통령령으로 영향평가의 예외사업과 재평가 예외사유를 규정한 점, 둘째 국가기관등에서 실시한 영향평가 결과에 대해 소프트웨어사업자의 재평가 요청권을 신설한 점 등에서 차이가 있다.
    • 3.3.2. 요구사항 상세화와 분할발주
    • 2017년 12월 19일 발표된 공공SW사업혁신방안에서는 제안요청서 요구사항 명확화를 달성하기 위한 실행방안으로 발주기술지원 확대, 사전설계사업(분할발주 등)의 시행근거 마련, 제안요청서 요구사항 상세화 수준 사전심사제 도입을 제시하였다.16)
    • 이에 따라 입법예고안에서는 제57조(요구사항 상세화 등)에서 제안요청서에 과업규모를 산정할 수 있는 상세한 요구사항을 담을 것을 명시하고, 제59조(제안요청서에 대한 의견제시) 에서는 과학기술정보통신부장관 또는 행정안전부장관이 사업공고 전에 심사하여 의견을 제시할 수 있도록 하고, 제62조(소프트웨어사업의 설계․구현사업 분리)로 분할발주의 시행근거를 마련하고 제47조(발주기술지원)로 발주기술지원을 확대하도록 규정하였다.
    • 그러나 국회제출안에서는 요구사항 상세화와 분할발주가 제43조(소프트웨어사업의 과업 범위)로 통합되면서 내용이 간략해졌다. 제안요청서에 대한 별도의 의견제시 기능은 제46조(소프트웨어사업 추진 시 사전협의)의 사전협의와 제56조(소프트웨어사업 관리․감독 및 개선권고)에 따른 관리감독으로 이원화된 것으로 보이며, 설계사업과 구현사업의 분리는 요구사항 상세화를 위한 수단적 성격이 강하기 때문에 발주기관의 재량으로 실시할 수 있도록 제43조 제3항으로 통합되었다.
    • 3.3.3. SW사업 하도급제한
    • 입법예고안 제63조(하도급 제한 등)에서는 SW사업의 재하도급을 전면 금지하였으나, 국회제출안 제50조(하도급 제한 등)에서는 SW사업의 재하도급을 예외적으로 허용하도록 하여 현행법과 유사해졌다. 다만, 재재하도급은 어떠한 경우라도 허용되지 않음을 명시하였고, 현행법에 명시된 예외적 허용사유가 삭제되고 시행령에 위임되었기 때문에 향후 재하도급의 허용범위는 상당히 좁혀질 수도 있다.
    • 3.4. 기타
    • 3.4.1. 전문기관 지정과 업무의 위탁
    • 현행법과 입법예고안에서는 SW품질인증 등 SW진흥을 위한 각종 업무를 수행할 기관을 지정하도록 규정했으나 개별 조문마다 유사한 지정요건과 지정취소요건이 반복되었다. 또한 법률상 업무의 중요성과 공공성 때문에 다수의 민간 기관이 아닌 소수의 공공단체 등에 실질적으로 업무 위탁이 이뤄지는 점을 감안하여 국회제출안 제71조(업무의 위탁)를 신설하여 대통령령에 따라 SW진흥을 위한 각종 업무의 위탁이 이뤄질 수 있도록 하였다.
    • 3.4.2. SW품질성능평가시험과 인증제도
    • 기술력을 갖춘 국내 상용SW업체에 보다 많은 시장참여 기회를 제공하고자 2016년부터 의무화된 SW품질성능평가시험은 국가기관등이 비용을 부담해 실시해야 함에도 불구하고 법적 근거 없이 SW공급자가 일정비용 이상을 부담해야해 비판의 목소리가 높았다.17) 이번 입법예고안과 국회제출안에는 SW품질성능 평가시험의 비용을 SW공급자가 일부 부담할 수 있도록 명시해 법적 근거를 마련하였다.
    • 한편, 법제처의 입법기준편람에 따르면 SW진흥법 상의 각종 인증제도는 검사(시험)업무와 유사하며 임의인증제도로 분류되나, 우선구매나 사업자선정 때의 각종 혜택으로 인해 공공SW시장에 한해서는 준(準) 강제인증의 성격을 가진 것으로 보인다.18) 국회제출안에서는 공공SW사업 추진 시 소프트웨어프로세스 품질인증 보유기업을 우대할 수 있도록 명시하고 있는데, 공공SW사업 수주에 인증가산점의 영향력이 커져 필수적인 것으로 인식될 경우 인증비용과 소요시간 등 인증부담에 관하여 논란이 있을 수 있어 하위법령 제정 시 이를 고려할 필요가 있다19).
    • 3.5. 민간투자형 SW사업
    • 3.5.1. 민관협력사업 또는 민간투자사업의 개관
    • 국가는 건강하고 쾌적한 환경에서 생활할 권리, 사회보장에 관한 권리 등과 같이 헌법에 나열된 다양한 기본권들을 보장하고 실현하는 헌법적 의무를 부담하고 있는데, 이를 위해서는 적정한 사회기반시설(Infrastructure)을 확보해야 한다. 전통적으로 사회기반시설은 국가를 포함한 공공부문에서 예산으로 담당해 왔는데, 충분한 예산이 없다면 민간의 자본을 활용하자는 민관협력사업(Public-Private-Partnership)이 18세기 영국과 미국을 시작으로 전세계적으로 도입되기 시작했다. 국내에서도 1968년부터 도로법 등 개별법에 따라서 산발적으로 민간투자사업을 추진해 오다가 , 1994년 「사회간접자본시설에대한민간자본유치촉진법」을 제정하여 법체계를 정비하고, 1998년 한차례 전부개정하고, 2005년 법률명칭을 「사회기반시설에 대한 민간투자법」을 변경하고 대상범위를 넓혀가며 현재에 이르고 있다.
    • 현행 민간투자법은 도로, 철도, 항만, 공항 등 외에도 최근에는 학교, 보육시설, 자연휴양림 등까지 다양한 유형(有形)의 시설에 대한 민간투자를 규율하고 있으며, 정보통신 분야와 직접 연관되는 사회기반시설로는 정보통신망, 초고속정보통신망, 지능형 교통체계, 공간정보체계 등이 포함되어 있는데, 일반적으로 국가기관등에서 추진하는 공공SW사업은 사회기반시설에 포함되어 있지 않다.
    • 3.5.2. 새로운 유형의 민간투자사업
    • 1990년대 이후 전세계적으로 공공부문에서도 정보화가 진전되면서 각종 정보 시스템의 규모가 커지고, 다수의 국민들이 사용하는 사례가 늘면서 기반시설의 성격을 일부 가지게 되었다. 민관협력 정보화사업의 성공사례로 널리 알려진 싱가포르 전자통관망 ‘TradeNet’ 사업은 싱가포르를 드나드는 무역업자, 각종 운송사업자들뿐 아니라 항만, 무역, 항공, 세관 등 관리당국이 사용하는 시스템으로 사회기반시설에 해당한다고 볼 수 있으며, 국내에서도 국세청의 연말정산 시스템이나 민원24는 일반 국민들의 생활에 꼭 필요한 정보시스템이라고 할 수 있다. 또한 내부 행정업무 효율화에 집중하던 전자정부의 패러다임은 서서히 공공데이터를 개방하여 민간의 창의적 역량을 북돋우는 정부3.0, 사회문제를 해결해 나가는데 민관의 역량을 집결해야 한다는 사회문제해결형 연구개발로 전환되고 있다.
    • 따라서 국내에서는 그간 민간의 자본, 아이디어, 발전된 기술력을 활용할 수 있도록 민관협력형 SW사업의 도입에 관한 논의가 활발하게 이뤄졌으며, 입법예고안 및 국회제출안 모두 민관협력형 SW사업에 관한 규정을 마련한 바 있다.
    • 3.5.3. 민관협력형 SW사업의 실현방안 검토
    • 민관협력형 SW사업의 입법방식은 다음의 세 가지 방식이 있다. 첫째로 민간투자법을 수정하여 일정 요건을 충족하는 공공SW사업은 민간투자법에 따라 시행될 수 있게 하는 방안이다. 즉, 사회기반시설의 정의에 공공SW을 포함하는 것인데, 기존 민간투자법의 체계를 크게 수정하지 않아, 입법과정에서 민간투자법 소관부처의 부담이 덜하고 현재 진행되는 국가디지털전환시범사업의 성과에 따라 조속히 입법에 착수할 수 있다는 장점이 있다. 그러나 무형의 공공SW가 ‘시설’인지 여부, 그리고 ‘사회기반시설’인지에 관해 논란이 발생할 수 있으며, 민간투자법의 절차는 공공SW사업에는 알맞지 않기 때문에 실제 서비스까지 상당한 시간이 소요되는 단점이 있다.
    • 두번째 방법으로 민간투자법을 수정하되 민간투자법 내에 공공SW사업을 위한 특례조항을 만드는 방법이다. 이 경우 첫 번째 방안에 비해 개정해야하는 조항이 많기 때문에 소관부처의 부담이 크고, 민간투자법 및 관련 법령 전체에 영향을 미치기 때문에 충분한 검토가 필요하다.
    • 세번째로 국회제출안 제39조(민간투자형 SW사업) 규정과 같이 법적 근거를 별도로 마련하는 방안이다. 이미 개별법들에 의한 민간투자사업도 진행되고 있고 공공SW사업은 민간투자법이 규율하지 않는 영역이므로 별도의 법적 근거를 마련하는 것은 충분한 타당성이 있다. 다만, 입법예고안 제53조가 민간투자대상사업의 요건과 절차의 대강을 정하고 자세한 사항을 대통령령에 위임했던 것과는 달리 현재의 국회제출안은 민관협력형 SW사업이 가능하다는 것만을 명시하고 있어 시행령에서 보다 자세하게 제정하거나 별도의 지침이나 가이드가 수립될 필요가 있다.
    • 공공부문과 민간부문이 협력하여 추진하는 민관협력형 SW사업을 통해 다양한 사회문제를 국민들이 체감할 수 있는 수준으로 해결하거나 완화하며, 국가의 디지털 전환을 앞당길 수 있을 것이다.
    • 3.6. 결론
    • 2000년 SW산업진흥법 전부개정안 통과 이후 19년이 경과하였다. 그동안 SW의 중요성이 점점 커지고 가 국가 사회의 SW , 중추이면서 국민의 필수적 역량요소로 자리잡으면서 SW중심사회와 제4차 산업혁명이 점점 도래하고 있다. SW진흥법이 조속히 시행된다면 국가경쟁력 확보, 국민생활의 향상 및 국민경제의 건전하고 지속적인 발전에 이바지할 수 있을 것이다.
    • 4. 정책적 활용 내용
    • 이 연구보고서는 국회의 SW진흥법 심의과정과 하위법령 제정 과정에서의 참고자료로 활용될 수 있다.
    • 5. 기대효과
    • 국회에서의 법률안 심의가 원활히 진행되어 SW진흥법이 조속히 시행될 경우 국가경쟁력 확보, 국민생활의 향상 및 국민경제의 건전하고 지속적인 발전에 이바지할 수 있을 것이다.

    • 1. Purpose and Necessity of the Research
    • Since the SW Development Promotion Act of 1987, which is the basic law on SW, was fully revised as the SW Industry Promotion Act in 2000, ten times amendments were mainly focused on public sector SW project regulations until now.
    • In order to support the SW-oriented Society strategy in 2014 and to respond to changes such as the intelligence information society and the fourth industrial revolution discussed at the World Economic Forum in early 2016, the Ministry of Science and ICT launched the TF for the full amendment bill of SW Industry Promotion Act from August 2017. The amendment was fully publicized on December 20, 2017, and was open to public through government official website on March 22, 2018, and submitted to the National Assembly on November 30, 2018, after the State Council on November 27.
    • According to the government's legislative plan in 2018, the full amendment bill of SW Industry Promotion Act would have been submitted to the National Assembly until June. However, the consultation process among the government agencies proceeded in parallel with the regulatory review and legal review was delayed.
    • In this process, the whole revision version of the SW Industry Promotion Act submitted to the National Assembly is revised in much different from the first candidate and the legislative notice. Therefore, this research report compares and analyzes the change of the present SW Industry Promotion Act(current law), the legislative notice and the submitted bill to the National Assembly.
    • 2. Composition and Range
    • Chapter 1 summarizes the timeline of the submission to the National Assembly after the public hearing of the full amendment of SW Industry Promotion Act on December 20, 2017. Chapter 2 summarizes the legislative process of the government and analyzes the results of corruption and regulatory impact assessment in the legislative notice. In Chapter 3, we compare and analyze the current law, the legislative notice, and the submitted bill to the National Assembly for the limitations of the current law, the reasons of the legislative notice, and the meaning of the submitted bill with people’s opinions.
    • In Chapter 4, we analyzed the institutionalization of the PPP (Public Private Partnership) SW project and the article of the "Private Financing SW project" in the submitted bill and Chapter 5 expressed the summary of this report.
    • 3. Main Contents and Results
    • The purpose of this study is to examine the implications of the current law, the legislative notice, and the submitted bill to the National Assembly.
    • 3.1. SW Promotion Bill Overview
    • 3.1.1 Bill Structure
    • Typically, in Korea, an act has a hierarchy of chapter-section-article. The current act has 5 chapters and 47 articles. The legislative notice was 5 articles, 10 sections and 93 articles, and the submitted bill consists of 7 chapters, 9sections, and 73 articles. The submitted bill deleted the SW Project Dispute Arbitration Committee and merged some articles and added a few articles from the legislative notice. But, it keeps detailed section structure like the legislative notice.
    • 3.1.2 Corruption Impact Assessment and Regulation Impact Assessment
    • Corruption impact assessment and regulatory impact assessment are mandatory procedures for government legislation.
    • Corruption Impact Assessment System is to systematically analyze and evaluate the corruption-inducing factors inherent in laws and ordinances and to take precautionary and total improvement. For the articles containing organization or commissioner selection and delegation declared in the SW Promotion Bill, it is necessary to prevent corruption in advance by referring to Corruption impact assessment
    • Regulatory impact assessment is to judge the validity of regulations by predicting and analyzing various influences on the people's daily life, society, economy and administration owing to regulations by using objective and scientific methods. The legislative notice had four items for Regulatory Impact Assessment, (1) the cooperation duty of the SW companies for annual Industrial SW Survey, (2) the obligation of the selected companies in designing and implementing SW safety critical systems, (3) the prohibition of re-subcontracting the public sector SW project, and (4) the restrictions on the bidding due to the leakage of SW output. By regulatory impact assessment, the obligation of SW vendors to comply with the detailed SW safety standards is removed, and the prohibition of subcontracting the public sector SW project has been loosened.
    • 3.2. General Articles
    • 3.2.1 SW Industry
    • The definition of the SW industry first appeared in the SW Industrial Promotion Act of year 2000. From the e-government law revised in 2010, it became the same as the current law, However, in the submission of the National Assembly, there has been a change of deleting ‘information system’ related part. Changes in the definitions of the SW industry are directly reflected in the SW business, and are used to determine the scope of the public SW project that the heads of public agencies including state agencies conduct, with the SW Industry survey.
    • However, it is difficult to separate the SW project as a core element of the IT project from a IT project and there will be no substantial change because the public SW project forecasting system is integrated with ICT equipment forecasting system in Article 28 and 29 of the ICT Convergence Act.
    • 3.2.2. SW Safety
    • Because SW has been increasingly widespread and causes internal damage and direct damage to human life and body, ‘SW safety’ is newly introduced in public hearings and the legislative notice. Some experts pointed that the definition of SW safety on the legislative notice was confused with SW quality or information protection. In view of this, to distinguish SW safety from SW quality and information protection, harzard analysis and no external hacking are added the definition of SW safety of the submitted bill.
    • 3.2.3. Industrial SW Survey and SW Industry Information System
    • In order to survey a broader scope of SW, not just limited to the package SW and IT services as a sub-item of the ICT survey, the Industrial SW Survey is newly introduced. Because it is significantly overlapped with Article 14 (Management of SW Industry Information) of the current law, therefore, in the submitted bill, Article 7(management of SW industry information, etc.) has become very simple.
    • 3.2.4. SW Business operator and SW engineer management system
    • The current SW business registration system, which seems to be business licenses, is mainly concerned with the management of technical manpower and business performance of SW business operators. Therefore, the name of Article 57 changes as (Management of Software Business Operator Performance, etc.) and it is possible to request correct data to "head of government agencies etc. defined by Presidential Decree" in order to check the accuracy of the data submitted by SW vendors.
    • For the SW engineer in Small and Medium Enterprise has a difficulty in managing his own career, which is an important player of the SW ecosystem, the SW engineer career registration system was implemented on June 22, 2008. In the same purpose, the name of Article 24 of the submitted bill changes as (Software engineer's career, etc. check).
    • 3.2.5. SW R&D related Articles
    • In the legislative notice, the Open Source SW development method was officially introduced in the article of SW R&D. In the submitted bill, additional research and development related to SW engineering technology was added to enhance SW productivity and quality competitiveness of domestic companies. According to the explanatory document, the utilization of SW engineering technology in Korea is lower than that of developed countries, and the gap between large and small enterprises is getting widened. Therefore, legal basis of various support projects to strengthen the competitiveness of SW technology is introduced.
    • 3.3. SW Project Procedure Improvement
    • 3.3.1. SW Project Impact Assessment
    • The SW Project Impact Assessment System, which was introduced to prevent the violation of the private market caused by the development of the freely distributed SW by the governmental organizations or public institutions, was at first a review criteria of the National Informatization Implementation Plan under the National Informatization Act. Then it was included in the general supervision standard based on the current law. On July 21, 2017, a bill including the ‘SW project impact assessment’ submitted by the Senator Song Hee-kyung , passed on January 30, 2018 and became effective on August 21, 2018.
    • Compared with the current law, the submitted bill is different from the exceptions of the impact assessment by the Presidential Decree and reevaluation request by the SW vendors.
    • 3.3.2. Software Requirement Specification and Separate Contract
    • In the public sector SW project innovation policy announced on December 19, 2017, the implementation plan for the clarification of the RFP requirements is to expand the technical procurement support, to establish the legal basis of the preliminary design project through modular contract and to review the RFP in advance.
    • In the legislative notice, Article 57(Specification of requirements, etc.) specifies that the request for proposal shall include detailed requirements for assessing the size of the task, and Article 59(Review on the request for proposal) specifies that The Minister of Science and ICT or the Minister of Internals can review and present opinions before the official announcement of the project and a contract officer can make a separate contract under Article 62(Design and Implementation Separation of Public sector Software Project) and ICT public agency can support these procedures by Article 47(Technical procurement support).
    • However, the submitted bill merged those articles like the requirements specification and separate contract have been integrated into Article 43(scope of work of software project). RFP review appear to be integrated into supervision pursuant to Article 56(Software Project Management, Supervision and Improvement Recommendation). In addition, because the separation between design and implementation in a SW project is essentially a method of the detailed requirements of a RFP, it is incorporated into Article 43 (3) so that it can be carried out under the discretion of the organization.
    • 3.3.3. The limitation of SW project subcontract
    • In Article 63(Subcontracting Limitation) of the legislative notice, all the re-subcontracting of public sector SW projects was strictly prohibited, but Article 50 (Subcontracting Limitation) of the submitted bill made it similar to the existing law by allowing the re-subcontracting of the SW business under strict exceptional requirements. This change might be caused by the other ministries’ opinions that the strict prohibition of re-subcontracting will make it difficult to smoothly carry out the public sector SW project because of unavoidable circumstance change despite the negative effects of subcontracting and that it is excessive regulations in a view point of the freedom of a business.
    • 3.4. Miscellaneous
    • 3.4.1. Dedicated agency and Delegation
    • In the current law and the legislative notice, an dedicated agency to carry out various tasks for promoting SW, such as SW quality certification, is selected under the procedure mentioned in each article. But similar selection and cancellation requirements are repeated for each article. In consideration of the importance and public interest of the work in law and a few public organizations that performed those work until now, Article 71 (Delegation of duties) is newly introduced in a submitted bill so that various tasks can be delegated to a few entrusted organizations.
    • 3.4.2. Certification and Fee
    • According to the Legislation Handbook published by Ministry of Government Legislation, various certification systems in the a bill of SW Promotion Act are naturally the inspection(testing) tasks and classified as voluntary certification systems. However, due to many benefits in purchase priority or tender selection noticed, these seems to be compulsory certifications for SW vendors participating in the public sector SW market. Especially since 2016, Benchmark Test has been mandatory for the public agencies in order to provide more opportunities for Korean commercial SW vendors with technological capabilities. But the BMT fee became a new financial burden for the SW vendors though it should be a burden of public agencies because there is no legal basis that SW vendors participating in a BMT can be charged partially with a BMT fee.
    • The legislative notice and the submitted bill explicitly declare that SW vendors can be charged for a BMT fee. It should be considered that a certification system followed by affirmative actions like software process certification needs to have the explicit statement about certification fee.
    • 3.5. PPP SW Project
    • 3.5.1. Overview of PPP or PFI
    • The state has a constitutional obligation to guarantee and realize many basic rights listed in the Constitution such as the right to live in a healthy and pleasant environment, the right to social security, etc. To achieve these purposes, it is necessary to provide a proper infrastructure to people. Traditionally, social infrastructures have been budgeted in the public sector, including the state. In case that a budget is not enough, the PPP( Public-Private-Partnership) projects, which utilizes private investments, are introduced worldwide since United Kingdom and USA in 18th century. In Korea, since 1968, the private sector has been carrying out sporadic PPP projects in accordance with individual laws such as the Road Law. In 1994, the Law for the Promotion of Private Capital Investments in Social Overhead Capital Facilities was enacted. The title of the law has been changed to ‘Private Investment in Social Infrastructure Act’(briefly, PPP Act) and the scope has been continuously expanded until now.
    • In addition to roads, railways, ports and airports, the current PPP act regulates private financing in various types of facilities, including schools, childcare facilities, recreation forests, etc. In addition, Information communication network, high-speed information communication network, intelligent transportation system, and spatial information system are included. In general, public sector SW projects conducted by national agencies are not categorized in social infrastructures.
    • 3.5.2. New type of PPP
    • Since the 1990s, as the information technology has been widely used in the public sector all over the world, many IT systems became bigger than before. The TradeNet project of Singapore, which is widely known as a successful example of public-private partnership informatization project, is a system used by the authorities such as port, trade, airline and customs as well as traders and transportation companies that go to and depart from Singapore. In Korea, the tax settlement system of the Internal Revenue Service (IRS) and the civil affairs 24 are essential information systems for the general public. The e-government paradigm, which has focused on digitalizing internal administrative tasks, gradually transformed into government 3.0 by opening public data and encouraging private sectors’ creativity and a social problem-solving R&D project by the cooperation between public sector and private sector.
    • Therefore, in Korea, discussions on the introduction of private-public partnership SW projects to utilize private capital, ideas, and advanced technological power have been actively done, ideas, As a result, both the legislative notice and the submitted bill contain PPP SW Project article.
    • 3.5.3. PPP SW Project Legislation Review
    • There are three ways to legislate the public-private partnership SW project.
    • At First, by amending the PPP act to contain public sector SW projects that meet certain requirements in the scope of PPP project, those can be conducted following the amended PPP act. Because the modification is small, it has a merit of fast legislation if the pilot projects of national digital transformation shows the good result. However, heavy debates may arise as to whether the intangible SW is a 'facility' and 'social infrastructure', and it takes a considerable time to start a service since the procedure of PPP act is not suitable for SW project.
    • The second way is to amend PPP act with special provisions for the SW project. In this case, compared with the first way, many modifications may require sufficient reviews.
    • The third way is to make separate legal basis like Article 39 (PPP SW project) of the submitted bill. Since some PPP projects have been already conducted individual laws except PPP act and PPP SW projects are not regulated by PPP act, it is reasonable to establish separate legal basis. Article 53 of the legislative notice outlined the requirements and procedures of the projects to be privately funded and delegates the details to the Presidential Decree. However, because the submitted bill only declares that PPP SW projects are possible. It may be required more detailed guidelines for PPP SW projects.
    • The public-private partnership type SW project will solve or mitigate various social problems at a level known by the public and speed up the nation's digital transformation.
    • 3.6. Conclusion
    • It has passed 19 years since SW Industrial Promotion Act in 2000. In the meantime, the SW has become increasingly important as the core competence element of the nation and society as well as the essential competence factor of the people, and the SW-oriented society and the 4th industrial revolution are coming more and more closely. If the SW Promotion Act is enacted, it will contribute to upgrading national competitiveness, improving people's welfare, and contributing to sound and sustainable development of the national economy.
    • 4. Policy use
    • This research report can be used as a reference in the deliberation process of the SW promotion act of the National Assembly and in the process of enactment of the Presidential Decree and Ordinances.
    • 5. Research Implication and Expected Effects
    • If the deliberation of the submitted bill in the National Assembly will proceed smoothly by this report and the SW Promotion Act is enforced soon, it will contribute to upgrade national competitiveness, improving the lives of the people and sound and continuous development of the national economy.
