    • 데이터가 가진 고유의 문제는 데이터 소유권과 개인정보보호 이슈이다. 우선, 기존의 법은 데이터의 가변성으로 인해 데이터에 배타적 독점권을 설정하기 어렵다. 데이터 위에 권리를 설정하려면 그 주체가 명확해야 하고, 범위도 확정되어야 하기 때문이다. 다만, 최근 국회는 신용정보 데이터에 채권적 권리를 부여하였고, 권리 주체 확정이 비교적 쉬운 비개인정보에 권리를 부여하는 방안에 대해 논의하고 있다. 다음으로 데이터3법이 개정되면서 개인정보보호 이슈는 일부분 정리되었다. 개인정보자기결정권의 보호와 신산업 발전을 이루기 위해서 점진적인 방식을 취한 것으로 보인다. 데이터3법은 가명정보 처리, 신용정보주체의 전송요구권 제도를 도입하였는데, 데이터 경제의 초석이 될 것으로 생각한다. 개정된 내용의 효용을 따져서 지속적으로 법을 개정하는 방식이 사회적 합의를 이루는데 보다 도움이 될 것이다.
    • 공정한 데이터 시장의 논의사항으로 데이터 격차, 데이터 주권, 데이터 이익분배 논의가 있다. 먼저, 데이터 격차는 경쟁자인 기업 간의 데이터 격차가 불공정한 시장을 조성할 우려로 등장한 논의이다. 마찬가지로 데이터 주권은 국가 간의 데이터 격차로부터 헌법에 따른 자국민과 기업을 보호가 필요하다는 논의이다. 마지막으로 데이터 이익분배는 데이터를 수집·활용해 이익을 창출한 기업과 데이터를 제공한 정부주체가 상호 이익을 공유하자는 논의이다. 이상의 논의는 데이터 생태계에서 모든 당사자가 개방과 공유를 할 수 있도록 하는 방안에 대해 새로운 시각을 보여준다.
    • 데이터 경제가 이미 도래했음에도 불구하고, 제도적 측면에서 다소 미흡한 점이 있음을 부인할 수 없다. 그래서 정부와 국회는 관련해서 법·제도를 점진적으로 마련하고 있다. 그 과정에서 기존 법·제도와 경제 시스템에만 매몰되지 않는 것이 중요하다.
  • Executive Summary
    • The data economy requires a system that collects and continuously circulates data. However, we know that data generated across industries is being collected from electronic storage devices, but we do not know whether the collected data is continuously being circulated. This study revealed the inherent problems of data in the cycle of data openness and sharing, and discussed and identified issues for the data economy.
    • The inherent problems with data are data ownership and privacy issues. First of all, it is difficult for the existing law to establish an exclusive right to data due to its variability. This is because, in order to set rights on data, the subject must be clear and the scope must also be determined. However, recently, the National Assembly has granted a bond right to data, and is discussing ways to grant rights to non-personal information, which is relatively easy to determine the subject of the right. Next, with the revision of the 「Data 3 Act」, the privacy issues were partially resolved. It seems to have taken a gradual approach to protect the right to self-determination of personal information and achieve industrial development. The 「Data 3 Act」 introduced a system for processing pseudonymous information and requesting transmission of credit information subjects, which I think will become a cornerstone of the data economy. A method of continuously amending the law by examining the utility of the revised content will be more helpful in achieving a social consensus.
    • Discussions related to the data economy include the data divide, data sovereignty, and data dividends. First, the data gap is a discussion that emerged due to concerns that the data gap between competitors would create an unfair market. Similarly, data sovereignty is an argument for states to protect their citizens and their businesses according to the constitution in relation to the data gap between countries. Finally, data dividends is a discussion about sharing mutual benefits between companies that have collected and utilized data and generated profits and the government entity that provided data. The above discussion reveals new perspectives on how to enable openness and sharing by all parties in the data ecosystem.
    • Although the data economy has already arrived, there are some shortcomings. Therefore, the government and the National Assembly are gradually preparing related laws and systems. In the process, it is important not to become engrossed in laws and institutions within the existing economic system.
