가상화폐 투기 근절, 거래소 폐쇄만이 정답인가?

    • To eradicate the virtual currency speculation, is it the only answer, the closing of exchange?
    • 최근 가상화폐1의 투기 현상이 심상치 않다. 2018년 1월 11일 관계부처와의 조율 없이 최악의 경우 가상화폐 거래소 폐쇄까지 검토할 수 있다는 법무부의 단독 발표에 많은 사람이 적잖은 충격을 받았다. 이를 방증하듯 2018년 1월 12일 현재 가상화폐 거래소 폐쇄를 반대하는 청와대 국민청원에 10만 명 이상의 국민이 참여하고 있다. 가상화폐 시장 역시 큰 폭으로 출렁였다. 법무부 발표 직후 가상화폐의 전반적인 시세가 20~30% 폭락하였다. 이러한 현상은 가상화폐에 대한 관심이 그 어느 때보다 높기 때문이라 생각한다.
    • 지금의 가상화폐 투기와 거품 현상은 가상화폐의‘ 미래가치’보다는 단기간 투자로 시세차익을 보려는 심리 때문이다. 가상화폐는 인터넷만 된다면 중앙의 통제를 받지 않고 전 세계 어디에서나 사용할 수 있는 미래가치가 높은 기술임은 틀림없다. 분명 가까운 미래에는 그 가치를 인정받고 일상에서 통용되는 것은 자명해 보인다. 그러나 지금의 현실은 투기로 인해 수많은 피해자가 발생하고 사회 혼란이 발생할 가능성이 더 높다. 개인적인 마음 같아서는 이러한 엄청난 피해와 혼란이 발생하기 전에 가상화폐 거래소 폐쇄보다도 더 강한 규제가 필요해 보인다.
    • 그러나, 가상화폐 거래소 폐쇄는 그렇게 단순한 문제가 아니다. 당장의 거래소 폐쇄는 투기 광풍을 잠시 잠재울 수는 있지만 결국 다른 방법으로 투기는 계속될 것이다. 충분한 논의와 깊은 고민 없이 거래소를 폐쇄한다면 또 다른 문제점들을 양산하고 그때마다‘ 임시 처방’으로 대처하는 악순환이 되풀이될 가능성이 높다. 따라서 폐쇄로 인해 발생할 수 있는 부작용에 대해 다각도에서의 논의가 필요한 때이다.
    • 거래소 폐쇄로 인해 예상되는 부작용은 크게 네 가지 정도로 정리할 수 있다.
    • 첫째, 대량의 외화가 불법적인 방법으로 해외 유출될 가능성이 높다. 지금 국내의 가상화폐 열기를 고려하면 거래가 가능한 해외 가상화폐 거래소로 국내 자금이 몰릴 가능성이 매우 높다. 이 경우 원화를 외화로 환전 후 송금을 해야 한다‘. 외국환거래법’에 의해 해외송금에 제약이 생기는 경우 음성적인 방법을 사용할 가능성이 크다. 그로 인해 국내 가상화폐 투자자들은 잠재적인 범죄자가 될 수 있다. 또한 환전 및 송금 수수료, 해외 브로커 수수료 등이 발생하여 해외 투자자보다 국내 투자자들이 피해를 보는 역차별이 발생할 수 있다.
    • 둘째, 해외 가상화폐 거래소 이용으로 인해 발생하는 피해를 구제받기 어려워진다. 물론 국내 거래소에서 발생한 사고에 대해 피해 보상을 받기도 쉽지는 않다. 하지만 해외에서 발생한 사고에 대해 개인이 피해 보상을 받기란 더더욱 어려운 것이 현실이다. 또한 가상화폐 거래소로 위장한 해외 사기로 인해 국내 투자자들의 피해가 발생할 가능성도 무시할 수 없다. 지금도 한국 투자자를 노리는 사기행각이 늘어가는 추세에서 국내 거래소 폐쇄는 이를 더 부추길 가능성이 높다.
    • 셋째, 국내에서 가상화폐로 재화 및 서비스 구매가 어려워진다. 가상화폐를 얻기 위해서는 직접‘ 채굴’하거나 가상화폐 거래소를 이용하여 법정화폐를 가상화폐로 교환해야 한다. 직접 채굴하는 방법은 현실적이지 않기 때문에 대부분 거래소를 이용한다. 그러나 거래소가 폐쇄되면 가상화폐 환전이 매우 어렵고 불편해진다. 결국, 가상화폐 사용이 위축될 수밖에 없고 더 나아가 블록체인을 기반으로 하는 산업까지 위축될 수 있다. 제4차 산업혁명의 중요한 원동력 중 하나인 블록체인 산업의 위축은 득보다 실이 많아 보인다.
    • 넷째, 가상화폐의 근간인 블록체인 기술에 대한 부정적인 인식이 퍼질 수 있다. 사실 가상화폐 거래소 폐쇄가 블록체인 기술 발전에 직접적인 영향을 주지는 않지만, 해당 기술에 대해 잘 알지 못하는 많은 이들에게 블록체인 기술 자체에 대해 부정적인 인상을 심어줄 수 있다. 이는 단기적으로는 블록체인 기술에 근간을 둔 국내 기업에 대한 투자가 위축될 수 있다. 그로 인해 블록체인 관련 국내 기업이 경쟁력을 갖지 못하면, 극단적이지만 해외 기업이 국내 블록체인 시장을 모두 잠식할 수도 있다는 시나리오도 무시할 수 없게 된다.
    • 일본은 2017년 4월 1일 비트코인을 포함한 가상화폐를 대상으로 한‘ 기금 정산에 관한 법률’ 및‘ 범죄 수익 이전 방지법’ 개정안이 시행됐다. 이로 인해 비트코인의 거래가 급속히 늘고 있으며 가상화폐를 사용할 수 있는 점포도 26만 개로 늘어났다. 가상화폐를 통화로 인정하고 제도권 안으로 흡수한 일본 역시 크고 작은 이슈로 골머리를 썩이고 있지만 그래도 차근차근 해결해 나가고 있다. 우리도 지금의 투기 광풍을 잠재우고 블록체인을 바탕으로 제2의 도약을 할 수 있도록 현명한 판단이 절실하게 필요한 때이다.

I think this phenomenon would be because public interest in virtual currency is higher than ever.
    • The current speculation and bubble phenomenon of virtual currency are due to the psychology that seeks profit margin by short-term investment rather than the “future value” of virtual currency. Virtual currency is a technology with a high future value that can be used anywhere in the world without the centralized authorities only if the Internet is available. Clearly, in the near future it would be recognized and used in everyday life.
    • However, the reality is that dangerous speculative bubble may cause a lot of victims and social chaos. Personally, it seems that stronger regulations are needed than the closure of virtual currency exchanges before such enormous damage and confusion would arise. However, closing the virtual currency exchange is not such a simple matter. Immediate closing of the exchange may cover up the “crazy” speculation temporarily, but speculation will continue in other ways. If the exchanges are shut down without sufficient discussion and deep consideration, it is likely that the vicious cycle of producing other problems and dealing with “temporary prescriptions” will be repeated. Therefore, it is necessary to discuss various side effects of the closure.
    • The anticipated side effects of closing the exchanges can be roughly classified into four categories.
    • Firstly, there is a high probability that a large amount of foreign currency will flow out illegally to foreign countries. Considering the popularity of the domestic virtual currency market, it is very likely that the domestic money will be poured into the overseas virtual currency exchanges where transactions can be made. In this case, the domestic currency must be converted into foreign currency and transferred. Since the “Foreign Exchange Transactions Act” restricts overseas remittance, it is highly likely to use a negative method. As a result, domestic virtual currency investors could become potential criminals. In addition, exchange and transfer fees, foreign broker fees, etc. may occur, which many result in reverse discrimination in which domestic investors are injured rather than foreign investors.
    • Secondly, the damage caused by the use of overseas virtual currency exchange becomes more difficult to be rescued. Of course, it is not easy to receive damage compensation for accidents at domestic exchanges. It is true, however, that it is even more difficult for individuals to receive compensation for accidents that occur overseas. In addition, the possibility of damages to domestic investors due to foreign fraud, which is disguised as a virtual currency exchange, cannot be ignored. It is highly probable that the closing of domestic exchanges will further stimulate fraud in an attempt to attack Korean investors.
    • Thirdly, it becomes difficult to purchase goods and services with virtual currency in Korea. In order to obtain virtual currency, you must either directly “mine” it or use a virtual currency exchange to exchange the fiat currency for virtual currency. Since the method of direct mining is not realistic, most of them use the exchange. However, if the exchange is closed, exchanging virtual currency is very difficult and annoying. As a result, the use of virtual currency is inevitably shrinking, and even the industry based on blockchain could be shrunk. The blockchain industry, one of the important driving forces of the Fourth Industrial Revolution, would be shrinking and it seems to be more damaging than gaining.
    • Fourthly, negative awareness of blockchain technology, which is the basis of virtual currency, can spread. In fact, although the closing of virtual currency exchanges does not directly affect the advance of blockchain technology, it could impose a negative image on the blockchain technology itself to many who are unfamiliar with the technology. In the short term, investment in domestic companies based on blockchain technology can be shrinking. As a result, if the domestic companies involved in the blockchain do not have the competitiveness, it is impossible to ignore the scenario that the foreign companies may encroach on the domestic blockchain market.
    • On April 1, 2017, Japan introduced amendments to the “Act on Settlement of Funds” and “Act on Prevention of Transfer of Criminal Proceeds” for virtual currencies including Bitcoin. As a result, transactions for Bitcoin are rapidly increasing, and the number of virtual currencyenabled stores has increased to 260,000. Japan, which recognizes virtual currencies as legal currencies and absorbs them into the system, is also troubled by big and small issues, but it is still solving them one by one. We also need to make wise decisions so that we can take the second leap on the basis of the blockchain.
