본고는 특허법 개정안의 온라인 실시에 대해 검토하며 그에 따른 저작권법과의 이해관계가 충돌하는 사항에 대해 살펴보고자 한다.

SW는 저작권 및 특허권으로서 보호받을 수 있는 영역이기 때문에 저작권법의 보호를 주장하는 측과 특허법의 보호를 주장하는 측의 이해가 상충하는 경우도 있다. 양법의 입법목적이 상이하기 때문에 서로 다른 보호체계를 갖지만, 이용자의 입장에서는 저작권과 특허권의 차이로 인한 의도치 않는 문제에 직면하게 된다.

현행 법률은 진흥법임에도 그 내용에서는 진흥과는 거리가 있어, SW중심사회에 맞게 SW산업진흥법의 체계를 재구성할 필요성이 커지고 있다.

엄격한 특허법의 해석을 통해 특허범위를 한정함으로써 SW기술의 발전을 이끌 수 있다는 긍정적인 견해도 제기된다. 이를 위해 실무적으로 엄격한 청구범위의 작성 등이 이루어져야할 것이며, SW출원 및 심사 과정에서도 발명의 성립성을 포함하여 신규성, 진보성에 대한 판단이 이루어져야할 것이다.

사행성게임물이 사회문제가 되면서, 게임정책은 진흥이 아닌 규제로 바뀌게 된다. 그 결과 게임산업법은 사행성게임물 확인, 내용수정, 셧다운(shut-down), 등급 거부 등 지속적인 규제 법제로서 역할을 하게 되었다. 문제는 규제가 게임산업을 포함하여, 시민의 문화적 다양성까지 훼손할 수 있다는 점이다.

게임소프트웨어에 대한 셧다운과 같이 그 수단의 적정성이 확보되지 못한 행위는 목적의 정당성을 훼손하게 된다. 정책당국도 정책을 수립하거나 집행함에 있어 수혜(受惠)가 아닌 균형(均衡)을 통해 가치를 높이는 것에 있음을 이해할 필요가 있다.

분명한 것은 이러한 변화들은 전기에 기반한 다양한 이동형 기기들이 등장하기 시작했다는 것입니다. 기존의 동력으로 이동하는 것은 오토바이, 자동차 정도로 단순하게 나누어지던 시대와는 사뭇 달라지게 됩니다. 크기도 크게 줄어들고, 충전 하는 곳 역시 주유소가 아닌 생활 곳곳으로 녹아듭니다. 이렇게 작아진 기기와 세분화된 다양한 기기들이 의미하는 것은 개인의 목적별로 다양한 수단의 기기를 선택할 수 있음을 의미하기도 합니다.
